I was traveling on Murfreesboro Pike when I noticed a vehicle failing to stop for the flashing red light on Fesslers Lane. I had to apply my brakes to avoid a crash. When I conducted a traffic stop and spoke with the driver, Ms. Fortuna, she appeared confused about the traffic light and intersection. I noticed the odor of an alcoholic beverage coming from her person. She stated she had consumed a few drinks, but “not too much.” I asked Ms. Fortuna to perform SFST and noticed several indicators of impairment. I took her into custody and asked her to read the Implied consent form. She stated she had always been told to refuse the test and did not consent to a breath test after reading the form.
