Barback’s 4th DUI Arrest: James ‘Jason’ Gruzinsky Blows .258

James ‘Jason’ Gruzinsky, a barback at Double E Bar & Grill, blew a .258 in the early hours of Monday morning, more than 3 times the legal limit. Gruzinsky does not have a driver’s license due to previous DUI convictions. This is his 4th DUI arrest, and he is listed as a habitual driving offender in TN.

On 10/15/17 at approximately 2315 hours I was traveling on Lebanon Pike. An Audi sedan passed me traveling the same direction. The vehicle swerved three times over the fog line (less than ¾ mile). I activated my emergency lights and the vehicle was slow to come to a stop. I made contact with the driver and observed that his eyes were watery and his speech was slurred. The defendant had a distinct odor of an alcoholic beverage emitting from his expelled breath. The defendant admitted to consuming alcohol. Upon exiting the vehicle he was unsteady on his feet and swayed while standing. I administered HGN and observed validated indicators of impairment. I attempted to administer the remainder of the SFST’s but the defendant was unable to stand in the proper position for the walk and turn. The SFST’s were stopped for safety reasons. The defendant stated he should not have been driving. The defendant was taken into custody and read the Implied Consent form. He agreed to the requested breath test. The result of that breath test was .258. Incident was Audio and Video Recorded.

05/04/2007: 2nd DUI Arrest

THIS DEFENDANT WAS DRIVING A MOTOR VEHICLE ON TULIP GROVE RD. IN NASHVILLE / DAVIDSON COUNTY. I OBSERVED THE VEHICLE DRIVE OFF OF THE ROADWAY ONTO THE SHOULDER OF THE ROAD AND AT ONE POINT INTO A DITCH. THE VEHICLE WAS WEAVING ACROSS THE CENTER LINE AND IN A VERY RECKLESS MANOR. I STOPPED THE VEHICLE AND NOTICED A VERY STRONG ODER OF AN A/B ON THE BREATH AND ABOUT THE PERSON OF THE DEFENDANT. THE SUBJECT STAGGERED AND COULD NOT STAND WITHOUT ASSISTANCE AND COULD NOT FOLLOW INSTRUCTIONS OR COMPLETE FIELD TESTS W/O ENDANGERING HIS SAFETY. HE SAID, AFTER MIRANDA RIGHTS, HE HAD DRANK A 6 PACK OF BUSCH 12 OZ. BEERS AND BEERS WERE FOUND IN THE VEHICLE. THE DEFENDANT ALSO SAID ” IM A DUMB ASS AND I FUCKED UP. IM TOO DRUNK TO TRY TO DRIVE.” HE CONSENTED TO A BAC TEST AND TESTED .186.

Police initially responded to a traffic accident involving only property damage. Upon investigation, it was determined that the defendant (James Gruzinsky) was the driver of the vehicle. The defendant was observed by police to have a strong odor of alcohol about his person. Defendant also staggered as he walked. Defendant had difficulty completing the field sobriety tasks police asked him to perform. When questioned, the defendant admitted to drinking 2 shots of vodka and a 24oz. beer earlier in the afternoon. Upon further investigation it was determined that the defendant was driving on a revoked license which was revoked for DUI. The defendant was convicted of his second DUI in 2005.
