Jonathan Burr, of Marsden Ave in East Nashville, was arrested just before 3AM on Wednesday morning in East Nashville (at our officer’s favorite DUI spot, of course) and charged with DUI & Implied Consent refusal. Burr is the front man of local electro-pop outfit ‘How I Became The Bomb‘.
Burr states that he was coming from the hockey game downtown when he approached the intersection at N 11th & Gartland. There was a pedestrian about to use the crosswalk, and Burr admits he did not see the pedestrian on the corner of the intersection. He then also failed to come to a stop before making the right hand turn into the intersection. Jonathan Burr continued, and made a left turn onto N 12th St without using a turn signal. At this point MNPD Officer Dugre stopped Burr for traffic violations and made contact with him.
Per the sworn affidavit, the officer reports that he observed signs of impairment including dilated pupils and what appeared to be a dry mouth. He could smell alcohol from the vehicle, but not from his expelled breath, and Burr explained it away by being at a bar he worked at, earlier in the evening.
At this point, Jonathan Burr exited the vehicle to do field sobriety tests, on which he exhibited signs of impairment per the affidavit. Initially, Burr said he only took 3 allergy mediations and arthiritis medication for his ankle.
During additional questioning, Bur admitted to taking both Hydrocodone and Percocet about an hour prior to being pulled over. Jonathan Burr made statements to the officer that he “should not have been driving after taking those medications”, and he had no prescription for them.
Burr was taken into custory and charged with 1 count of DUI, and 1 count of Implied Consent violation. He was given a $1,000 bond, which he made via Grumpy’s and was released just after 7:30AM on Wednesday. He will appear in court on 01/05/2018.
MNPD Affidavit
On 11/29/2017 at approximately 0122 hours, I observed a vehicle make a right hand turn from N 11th Street onto Gartland Ave. The vehicle did not yield to a pedestrian on the crosswalk that was about to use the crosswalk. Also the vehicle failed to come to a complete stop at the intersection prior to making the right hand turn. I then observed the vehicle make a left hand turn from Gartland Ave onto N 12th Street without using a turn signal. The vehicle was stopped for the traffic violations. Upon making contact with the driver and sole occupant of the vehicle, I observed signs of impairment. I observed that his pupils were dilated and he appeared to have dry mouth. He stated that he did not see the pedestrian that was on the corner of the intersection. I detected the odor of an alcoholic beverage coming from the interior of the vehicle. The defendant denied consuming any alcoholic beverages that evening but that he worked at a bar and had been there that night. As he spoke, I did not detect the odor of an alcoholic beverage on his expelled breath. He stated that he was coming from the hockey game downtown. He exited the vehicle and performed field sobriety tasks. During the performance of the fst’s, he exhibited indicators of impairment. He swayed while standing still during HGN and was unsteady on his feet during the walk and turn and one leg stand. He was asked if he had consumed any medications. He stated that he takes 3 different allergy medications and an arthritis medication for his left ankle. When asked again about medication use later on, he admitted to consuming Hydrocodone and Percocet. He indicated that he was not prescribed those by a doctor. He indicated that he took the medication that evening about an hour before the traffic stop. He made statements indicating that should not have been driving after taking those medications. Based on the observations of impairment and the driving observed, I believed that the defendant was under the influence and not able to operate a vehicle safety. He was placed under arrest for DUI. He was read the implied consent law and he refused the requested blood test.
Seriously people, this is the #1 DUI spot in East Nashville.I guess if you’re too drunk to drive, you’re too drunk to care.
