DUI Arrest: Ivory Nuby Gets 3rd DUI, While out on bail for 1.4 lbs marijuana.

Two weeks ago, Ivory Nuby of East Nashville was arrested with 1.4 lbs of marijuana because he ran a stop sign. On Thursday, Nuby was pulled over once again – this time for a non-illuminated license plate – and got his 3rd DUI Charge.

Court Affidavit:

ON 12/7/2017 OFFICERS OBSERVED THE DEFENDANT DRIVING ON BRICK CHURCH PIKE DURING THE HOURS OF DARKNESS. A TRAFFIC STOP WAS INITIATED DUE TO FAILURE TO ILLUMINATE LICENSE PLATE. UPON MAKING CONTACT WITH THE DEFENDANT, OFFICERS SMELLED THE ODOR OF ALCOHOL COMING FROM THE DEFENDANT. THE DEFENDANT’S EYES WERE BLOODSHOT AND WATERY. UNDER MIRANDA, THE DEFENDANT STATED HE DRANK A BUD LIGHT EARLIER AND HAD ALSO SMOKED MARIJUANA PRIOR TO DRIVING. THE DEFENDANT CONSENTED TO PERFORM STANDARD FIELD SOBRIETY TASKS. THE DEFENDANT SHOWED FOUR INDICATORS ON HGN, FOUR INDICATORS ON WALK AND TURN, AND TWO INDICATORS ON ONE LEG STAND. ARMS SHOWED THE DEFENDANT TO HAVE A REVOKED DRIVER’S LICENSE. THE DEFENDANT WAS CONVICTED OF DUI 2 IN 2014. THE DEFENDANT WAS READ THE TENNESSEE IMPLIED CONSENT ADVISEMENT AND CONSENTED TO A BLOOD DRAW.THE DEFENDANT HAS 3 FTAS IN HIS CRIMINAL HISTORY.

Nuby was charges with driving on revoked ($2500 bond) and DUI 3rd ($7500 bond), and bailed out via Grumpy’s. He will appear in court on 01/12/2018.

Ivory Nuby III, of Creighton Ave in East Nashville, was stopped late Friday night for running a stop sign. When officer Kinnaird approached the vehicle, there was a strong odor of marijuana coming from inside, and a blunt was visible on the console between the seats.

A probably cause search resulted in a small amount of marijuana in the compartment under the radio, and 1.4 pounds (635 grams) of marijuana inside a plastic shopping bag in the trunk of the vehicle. Upon a search of his person, additional marijuana was found in his jacket pocket, along with $355 in cash.

Nuby claimed ownership of all of the marijuana that was found, and was booked into the Davidson County Sheriff’s Department just after 10PM, and released just after 2AM on a $12,000 bond via A Around The Clock bonding. He faces driving on a revoked license and felony possession with intent, and will appear in court on 12/14.

MNPD Affidavit:

I stopped the defendant for running a stop sign. Upon approach of the vehicle I smelled a strong odor of marijuana coming from the vehicle and observed a burnt marijuana cigar in plain view on the console between the driver and passenger seat. A probable cause search revealed a small amount of marijuana in the compartment under the radio. Further search revealed a plastic shopping bag in the trunk containing two large bags of marijuana and a small amount was located in the defendant’s jacket pocket. Defendant also had $355.00 in US Currency on his person in denominations consistent with street level narcotic sales. Total weight of the marijuana was 635 grams (1.4 pounds). Defendant claimed ownership of the narcotics. Defendant was transported to Davidson County booking and charged with possession with intent of schedule VI.
