MNPD, You Petty: “Unattended Motor Vehicle” Charges

Sure it’s ‘technically’ illegal in Tennessee to leave your vehicle running if you’re not inside it. This includes in your own driveway during the winter (warming it up), running in the store for just a second, or literally any other time you’re more than a few feet from it.

In fact, the actual law states:

“No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, and effectively setting the brake thereon and, when standing upon any grade, turning the front wheels to the curb or side of the highway.”

Willisha Oliver is in court today, charged with TCA 55.8.162 – Unattended Motor Vehicle (for which she had a $250 bond at time of booking). On 11/20 Oliver pulled into a Nashville Mapco, when an officer observed her exit the vehicle and go inside the store with her vehicle running and the window open.

She was arrested and booked into the Davidson County Jail.

 

Court Affidavit:

ON 11/20/2017 THE DEFENDANT WAS OBSERVED PULLING OUT OF THE LOTUS INN ONTO PERCY PRIEST DRIVE AND THEN PULLING IN TO THE MAPCO AT 710 STEWARTS FERRY. OFFICERS OBSERVED THE DEFENDANT EXIT HER VEHICLE AND GO INSIDE THE BUSINESS WITH THE VEHICLE LEFT RUNNING AND A WINDOW LEFT OPEN.

    So basically you arrested her for nothing. Anything for a dollar I see. You could have easily issued her warning but y’all chose to arrest her on this simple act.
