2nd charged under Organized Retail Crime Act; Hit Target Stores 8 times in 10 days

Brooke Nicole Kelley, who was wanted as the other half of a Target theft team, has now been taken into custody and charged in Nashville. Her partner in crime was arrested in September of 2018.

According to Metro Police, between 07/22/18 and 07/31/18, Brooke Kelley shoplifted 5 times from the Charlotte Pike Target store, and 3 times from the White Bridge Road store. Each time, her product of choice was primarily DVDs, Blu-Ray discs, and 4K discs. After stealing the items from the store she would sell them at McKay’s Books, located on Old Hickory Boulevard. On at least two of the occasions, Brooke Kelley was assisted by her co-defendant, James Martin. In total, $2,930.44 wort of merchandise was stolen from Target, and McKay’s Books paid the pair $679.58 when it was sold to them.

Both were charged with felony organized retail crime, between $2500 and $10000, a class D felony. Martin was previously released on the pre-trial release program, however Brooke Kelley posted a $10,500 bond via Elite Bonding.

In order to be charged under the ORCA, one must “work with one (1) or more persons to commit theft of any merchandise with a value exceeding one thousand dollars ($1,000) aggregated over a ninety-day period with the intent to sell that property for monetary or other gain, or to fraudulently return the merchandise to a retail merchant”.
