Once Officer Nave approached the vehicle, he reports noticing bloodshot and watery eyes of the driver, along with slurred speech, and trouble understanding conversation and following directions., along with smelling alcohol coming from Glaskox’s breath. When Nave approached the vehicle, Glaskox advised the officer he had a handgun in the driver’s side door compartment, which was retrieved and found to be loaded with 5 live rounds in the magazine, and one in the chamber.

Glaskox agreed to submit to a breath test after reading the implied consent form three times, and blew a .083% BAC. According to the arrest warrant, Inside Glaskox’s vehicle officers found a “pill bottle in the center console that contained a variety of pills. Mr Glaskox stated two of the unmarked pills were Viagra”, and Nave was able to identify one of the pills as an amphetamine.
