Nashville Police charge man with felony for burning tiniest amount of weed he was smoking

While Nashville neighbors waited over 6 hours for a police response Saturday night, #MNPD Officer Daniel Russett noticed a man smoking marijuana downtown, yelled “Stop, drop what you got” and then charged him with a felony when he lit the tiny amount of weed on fire and burned it before the officer could reach him.

Officer Daniel J. Russett writes in an arrest report that he observed 34-year-old Tracy L. Potts smoking marijuana just before 10 p.m. Saturday night beside the pedestrian bridge near 3rd Ave. South. As Officer Russett yelled for Potts to stop smoking his pot and told him to drop what he had and not move, Potts is said to have dropped his marijuana pipe. As Officer Russett approached Potts grabbed the pipe and quickly lit the tiniest amount of marijuana that remained in the pipe on fire, burning it up completely.

A reportedly ‘visibly angered’ Officer Russett then attempted to take Potts into physical custody and says initially tried to pull away from the cuffs, but then complied. Russett writes that Potts “smelled of alcohol and marijuana” and had bloodshot and watery eyes, and admitted smoking and drinking.

Officer Russett charged Potts with FELONY tampering with evidence for burning the remaining weed in the pipe, possession of drug paraphernalia, public intoxication, and resisting arrest. As of Monday night, Potts remained jailed in lieu of a $7,500 bond.
