Man tells police “I’m so high I don’t know what to do” during DUI arrest

Locally known soccer player Vitaly Drake, 22, was charged with DUI, violating implied consent law, and unlawful possession of a controlled substance after he was stopped for driving on the wrong side of the road and stated he was coming to Nashville to buy marijuana.

Officers were driving around Hermitage Ave near Driftwood Ave on December 1st when they spotted a vehicle driving into oncoming traffic. Officers initiated their emergency lights on and the vehicle stopped. The driver turned from Fairfield Ave and realized he was on the wrong side of the road, according to a police report. When officers approached the driver, Vitaly Drake, they noted he was very nervous and had bloodshot, watery eyes. Vitaly was asked what he was doing and where he was coming from, to which he replied that he had not been drinking and eventually admitted to coming to Nashville to purchase marijuana. He consented to a search and officers found a small amount of marijuana in his center console.

Vitaly was detained and Mirandized. He stated again that he had not been drinking but had smoked something with friends. He said he trusted them but did not know what it was that he had smoked. Officers had Vitaly perform standard field sobriety tests and he showed signs of impairment on all segments of the tests and was taken into custody. Vitaly was read implied consent and was unsure how to answer. He asked the officers for advice stating: “I’m so high I don’t know what to do.”

After agreeing to a blood test and DRE (Drug Recognition Expert) evaluation he was transported to general. When the Drug Recognition Experts arrived Vitaly asked why he was there and what was going on, having forgotten why he was in the back of a police car and where he was going. Vitally then refused to get out of the car and submit to further testing and was taken to booking.

Vitaly Drake was charged with DUI, violation of implied consent, and possession of a controlled substance, and freed on pre-trial release. He is scheduled to appear in court in January.
