DUI: Retired MNPD Sergeant found with empty 5-liter Moscato wine box in front seat, gun in back – blows .245

58-year-old retired MNPD Sergeant Daniel Ogren was arrested Monday and charged with DUI and handgun possession while under the influence. Police found him with wet pants on the side of the road across from the Airways Motel, where he had just crashed a car into the curb. He blew a .245, had a .44 magnum handgun in the backseat, and an empty 5-liter Moscato wine box in the front seat – all before 10 a.m.

On 1/06/20 at around 10:00 a.m., Officer Nguyen observed the defendant, Daniel Ogren, urinating on the side of Lebanon Pike by the Airways Motel during his patrol. Police also observed a blue Huyandi Elentra parked on the side of Lebanon Pike close to a lane of travel. It is reported that Daniel was seen stumbling on his feet nearly collapsing to the ground multiple times. Based on these observations, police made contact with Daniel in the Airways’ parking lot. Officers went on to state that during contact they could smell an odor of alcohol transpiring from Daniel’s person and that he had bloodshot, watery eyes, and slurred his speech when he spoke. Daniel admitted to being the driver of the blue Elentra that just hit a curb 200 meters before 925 Lebanon Pike. Daniel said that he had to use the bathroom so he pulled over to the side of Lebanon Pike to urinate, however he had already urinated all over himself, according to Metro Police.

Police asked if he had consumed any alcohol and Daniel said that he had a glass of wine at 8:00 a.m. that morning. During the investigation, it was found that the Elentra was in fact registered in Daniel’s name and was running with the keys in the ignition the entire time. Police asked Daniel if he would consent to a standard field sobriety test to which he complied and subsequently failed. Police then read him Tennessee’s Implied Consent Law and he agreed to a breathalyzer test. The result of which came back as .245, more than three times the legal limit. Daniel then admitted to police that the was a .44 Magnum handgun inside his vehicle. During the search incident to the arrest, police located the firearm in the backseat of Daniel’s vehicle and also found an empty 5-liter box of Moscato wine in the front seat. There was also a 24-ounce bottle of water that was emptied and smelled like wine as well. Based on all the evidence collected Daniel was arrested and transported to booking.

Daniel Ogren was charged with DUI and possession of a handgun while under the influence and released freed on pre-trial release. He is scheduled to appear in court in February.
