While their mother was not present at the home, she did leave the children a phone in order to contact her. Diller had failed to answer the phone when the children attempted to call. Following questions to both the children and local residents, Martin discovered that the mother had left the two alone frequently without any adult presence.

Rachel Diller was arrested and charged with non-violent child abuse and neglect. Her bond was set at $20,000.
