Man waving gun around is charged with marijuana possession and resisting arrest

25-year-old Maxcell Miller was charged with possession of marijuana and resisting arrest after being reported for waving a gun in the air that led to police discovering marijuana on his person during a search.

On April 29th, officers arrived at the intersection of Rosa L Parks Blvd and Garfield Street to find the defendant, Maxcell Miller, with a handgun in his hand out in the open. When the defendant spotted the police officer, he quickly put the weapon in his pocket and put his arms in the air.

Officers conducted a search of his person and found a fully loaded weapon as well as six grams of marijuana and over one-hundred rounds of ammunition matching the same caliber of the pistol found in his pocket. His license was run through ARMS and found to be valid for a gun permit. After conducting the search Miller resisted getting into the back of the police vehicle and continued to give the police problems while transporting, requiring more officers to escort the defendant into booking.

Maxcell Miller was arrested and charged with possession of marijuana and resisting arrest. He was later freed on pre-trial release.
