45-year-old Robert Hawkins was charged with assault, public indecency, and public intoxication when he attacked a man with his family because he was asked to stop urinating on a 4th Avenue South sidewalk with his penis fully exposed.
On August 8th, Jonathan Snyder was walking along 4th Avenue outside of a Hilton Hotel with his family when he noticed the defendant, Robert Hawkins, urinating on the sidewalk. He stated that Hawkins’ penis was fully exposed and he asked him to not expose it to his children.
This upset Hawkins, who then aggressively charged him and pushed him. As Hawkins continued to advance, Snyder backed up and felt in fear for his safety so he pulled out his Smith and Wesson M&P Shield 9mm handgun. He told Hawkins to stay back, but Hawkins continued to advance causing Snyder to fall backward. As Hawkins tried to mount Snyder, a witness intervened and pulled Hawkins off of him as the police arrived and detained him. Multiple witnesses told the police the same story that Snyder told them and police noticed that Hawkins was severely intoxicated. The investigation showed that Hawkins had urinated when the police officer noticed a trail of liquid from the scene where the incident occurred.
When Hawkins was interviewed by the officer he acted surprised when he brought up to point where a gun was pulled on him. Also, while police were talking to him they noticed that he had slurred speech, erratic behavior, and the smell of alcohol on his breath. These signs as well as him being unsteady on his feet suggested that he was intoxicated. He did not offer any insight as to what transpired when a gun was pulled on him. Snyder then produced a valid Indiana handgun carry license.
Robert Hawkins was arrested and charged with assault, public intoxication, and public indecency. He was later freed on pre-trial release.
