Guzman told police that he observed Michael Wade attempt to steal items on September 7th, and was asked to sign a waiver saying he would not come back into the store. Wade returned the next day and attempted to steal items again. Since Kroger wanted to prosecute, the officers were able to prosecute on their behalf since the incident was a felony.
