23-year-old Roberto Herrera is charged with sexual battery and is free on a $5,000 bond. Police say he came to the home of his ex-girlfriend and requested to come in and “watch a movie”, which she agreed to, but told him she had a new boyfriend, and nothing “sexual” could happen. At some point during the Netflix he decided to chill and laid his head in her lap and pulled her closer to him when she attempted to get up. She told him she would call 911 if he didn’t stop, however, he then went to her bedroom and got into her bed, where she says he forcefully kissed her and rubbed her. Court records show she told him to leave, and he replied “I understand you don’t want meq, I will leave now”, and left the apartment. The victim says she felt unsafe, even after he left, and then called police.

| On 10/10/2021 around 0400 hours, I was dispatched to 5242 Edmondson Pike for a domestic-related sexual assault. Upon arrival I made contact with The Victim, The Defendant already fled prior to my arrival. The Victim and the defendant have dated in the past but have since ended their relationship. The victim stated that the defendant came over to her apartment unannounced and requested to come in to watch a movie. The Victim allowed the defendant to come in and made it clear to him that she has another significant other and there is to be no sexual or affectionate contact between them. The Victim stated they started watching a movie on the couch in her living room, at this time The Defendant started laying his head in her lap and when she attempted to get up to move away from the situation, he grabbed her and pulled her closer. The Victim stated to the defendant that she did not want him to persist with his actions and she would call emergency services if necessary. The Victim stated The Defendant understood but went to her bedroom and got in her bed, she followed and told him it was time for him to leave. The Victim stated The Defendant got up and started to forcefully kiss her and rub her breast. The victim pushed him away and told him to leave again. The Victim stated that the defendant then told her “I understand you don’t want me I will leave” and left. The victim called the police because she still felt unsafe and wanted police assistance. |
