21-year-old Seth Cann is charged with DUI after leaving a Halloween party and crashing his car. When asked for his insurance, he provided a Valvoline service card. Cann admitted to having two Truly drinks, and 3-4 tequila shots before driving. After urinating on himself in the breathalyzer room at booking, he is free on pre-trial release.

| Officers were dispatched to a motor vehicle crash at Ed Temple Blvd and Clarksville Pk. Upon arrival, officers observed the defendant to be sitting in the driver’s seat of his vehicle attempting to move his vehicle. Officers asked the defendant for his insurance card, and he presented officers with a Valvoline vehicle service card. The defendant had red, bloodshot watery eyes, and had a strong smell of alcoholic beverage emitting from his person. Officers asked the defendant if he had anything to drink, and he stated that he had consumed two Truly’s at a Halloween party that he was coming from. Officers asked the defendant to step out of his vehicle, and the defendant had to brace himself against the vehicle to maintain balance. The defendant was administered SFST’s, in which the defendant showed validated indicators of impairment. The defendant consented to a breath test and was transported to booking. While inside the breath test room, the defendant urinated on himself. The defendant was asked under Miranda how much alcohol he had consumed, and he stated that he had consumed three to four tequila shots before he drove. Due to technical difficulties with the intoximeter, officers were unable to get a breath test after two attempts. The defendant was booked with no further incident. |
