Metro Nashville Police found 61-year-old Ricky Lee Cook at the Johnny Cash Museum restaurant, where staff had asked him to leave after they deemed him to be a bother to staff and patrons, and he refused to do so. Police noticed he was heavily intoxicated, and took him into custody. During a search incidental to his arrest, officers located a leather satchel with a green Tupperware container inside, which contained his personal use marijuana. When asked, he confirmed it was marijuana, and stated: “I’ve been smoking pot for 50 years”. Police charged him with drug possession and public intoxication and transported him to jail. He is free on pre-trial release.

COMPLAINT:
2021-0577894
ARREST WARRANT / AFFIDAVIT:
On 11/08/2021, officers responded to 121 3rd Avenue South (Johnny Cash Museum) in regards to a disorderly person.

Upon arrival, officers made contact with the security guard at the Johnny Cash Restaurant that reported the defendant was inside the establishment making threats to the employees and citizens and refused to leave the property after being asked multiple times.

Upon officers’ contact with the defendant, officers observed his eyes were watery and red eyes, an odor of an intoxicating beverage emanated from his person, he was unsteady on his feet, and his speech was slurred. The defendant was having difficulty reporting his actions to officers.

During a search incident to custodial arrest, officers discovered a green Tupperware container in Mr. Cook’s leather satchel, containing a green-leafy substance. Due to the substance’s unique appearance and odor, and by training and experience, I suspected the substance to be Marijuana.

I read the defendant his Miranda advisement, whereby he agreed to answer questions without a lawyer present. He admitted that it was “pot” and that he had been smoking “pot” for 50 years. When I asked him if the substance was “Marijuana” he stated “yes”.

Due to the defendant’s obvious state of extreme intoxication, he was judged to be a danger to himself. He was transported to booking.
