DUI 2nd: Man admits to drinking ‘several beers’ before speeding alongside THP trooper — Frankie Messinger

36-year-old Frank ‘Frankie’ Messinger Jr. was booked into the Metro Nashville Jail over the holiday weekend after he was doing 70 mph in a 55 mph zone on I-40 while passing a state trooper. After he was pulled over he admitted to drinking ‘several beers’ prior to driving, and performed poorly on field sobriety tests. He was previously convicted of DUI in 2016, so he was charged with DUI 2nd and transported to booking. He is free on pre-trial release.

ARREST WARRANT / AFFIDAVIT:
On 11/26/2021 at approximately 0048 hrs. I (Trp. Justin Johnson) was on patrol in Davidson County on I-40 east bound near the 205.6 mile marker. My vehicle cruise was set at 65 mph and the speedometer is certified to be accurate. I was in a 55 mph zone and in my rearview mirror I observed a white sedan passing vehicles quickly in the right lane.

The vehicle then changed lanes to the left lane and approached my vehicle very quickly. The vehicle got beside me and applied the brakes in an aggressive manner causing the vehicle front end to lower. I estimated the vehicle’s minimum speed to be 70 mph in a 55 mph zone. I initiated a traffic stop and the vehicle took slightly longer than most to pull to the right shoulder. I made contact with the driver and only occupant of the vehicle who was identified as Frank R. Messinger Jr.

Mr. Messinger has very glossy eyes and they were slightly red in color. While speaking with Mr. Messinger a strong odor of an alcoholic beverage was detected emitting from his person. Mr. Messinger stated that he several beers prior to driving. He performed SFSTs poorly. I observed four out of six clues on HGN.

Lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes. For the walk and turn, I observed four out of eight clues. Cannot keep balance during instructions, missed heel to toe, stepped offline, and improper turn. For the one-leg stand, I observed three out of four clues. He swayed, used arms for balance, and put his foot down. Mr.

Messinger was arrested for DUI. He stated that he had a prior DUI conviction. A criminal history check returned he was convicted of DUI on 6/10/2016 in the state of Missouri.
