Georgia man charged after attempting to fight police outside Capitol Hotel downtown — David Phillip Messick

32-year-old David Phillip Messick, who was visiting Music City from Georgia, was booked into the Metro Nashville Jail after officers say he caused quite the disturbance at the Capitol Hotel in downtown Nashville. Management initially called police after he became extremely intoxicated and attempted to fight staff members. Officer arrived to find him yelling and screaming at staff and other patrons. As officers approached he wanted them to “don’t walk up on me!” and squared up with them while balling up his fists. Unimpressed with his chances at winning a fight, offices took Messick into custody against his will, while he kicked, screamed, pulled away from, and threatened violence toward, officers. Once in the patrol car, he had to be hobbled as he kept attempting to know out the windows of the unit. Messick is charged with resisting arrest, disorderly conduct, and public intoxication. He is free on a $2,000 bond.

ARREST WARRANT / AFFIDAVIT:
ON 12/18/2021 OFFICERS RESPONDED TO A DISPATCHED CALL FOR SERVICE AT 711 UNION ST (CAPITOL HOTEL NASHVILLE) FOR A DISORDERLY PERSON. UPON ARRIVAL OFFICERS MADE CONTACT WITH STAFF AT THE LOCATION WHO STATED THE SUSPECT, LATER IDENTIFIED AS MR. MESSICK, WAS VERY INTOXICATED AND WAS ATTEMPTING TO FIGHT STAFF MEMBERS.

OFFICERS LOCATED MR. MESSICK OUTSIDE THE LOCATION SCREAMING AT STAFF AND OTHER CUSTOMERS. OFFICERS MADE CONTACT WITH MR. MESSICK WHO WAS IRATE AND SHOWING MULTIPLE SIGNS OF IMPAIRMENT INCLUDING BEING UNSTEADY ON HIS FEET, SLURRED SPEECH, AND AN OBVIOUS ODOR OF ALCOHOL COMING FROM HIS EXPELLED BREATH.

AS OFFICERS ATTEMPTED TO SPEAK WITH MR. MESSICK, HE SHOVED OFFICER LEWIS STATING, “DON’T WALK UP ON ME.” HE THEN ASSUMED AN AGGRESSIVE STANCE SQUARING HIS SHOULDERS TOWARDS OFFICERS RAISING AND BALLING HIS FISTS.

AT THIS POINT OFFICERS DETERMINED MR. MESSICK WAS A DANGER TO HIMSELF AND OTHERS IF LEFT UNATTENDED AND THE OFFENSE OF DISORDERLY CONDUCT WOULD LIKELY CONTINUE. AS OFFICERS ATTEMPTED TO TAKE MR. MESSICK INTO CUSTODY, HE IMMEDIATELY BEGAN TO RESIST PULLING HIS ARMS AWAY FROM OFFICERS AND THREATENING VIOLENCE TOWARDS OFFICERS.

OFFICERS WERE EVENTUALLY ABLE TO TAKE MR. MESSICK INTO CUSTODY AND TRANSPORT HIM TO A MARKED PATROL UNIT. ONCE IN THE CAR MR. MESSICK BEGAN ATTEMPTING TO HIT THE BACK PASSENGER WINDOW WITH HIS HEAD AND SHOULDER. AT THIS POINT OFFICER WERE FORCED TO PLACE HOBLE RESTRAINTS ON MR. MESSICK TO PREVENT HIM FROM INJURING HIMSELF OR DAMAGING THE VEHICLE. MR. MESSICK WAS THEN TRANSPORTED TO BOOKING WITHOUT FURTHER INCIDENT.
