28-year-old Malcolm Seay was charged with possession of marijuana, driving with a suspended license, and evading arrest after he was pulled over for speeding. He was found to have a suspended license and to be in possession of marijuana stashed away in his car radio.

On May 18th, Officers Ward and Stanley noticed a car driving 23 miles faster than the regulated speed limit, driving at 93 miles per hour in a posted 70 zone. As Ward began to turn on his lights, the driver, later identified as Malcolm Seay, was initially cooperative. As Seay began to turn onto the shoulder of Interstate 40-West, he suddenly sped up and reentered the interstate. Weaving across traffic, he then exited off Stewart’s Ferry Pike, driving down the shoulder of the exit.

Following the exit from the interstate, Seay was stopped in red-light traffic, resulting in his arrest. Ward asked Seay to leave the vehicle and was immediately placed into custody. The officer noted that Seay had a “strong odor of marijuana”. Officer Stanley then located a bag of weed in the car’s radio compartment.

The license plate of the car was not registered to Seay, who claimed that he had bought the vehicle earlier in the afternoon. Upon further investigation, the driver’s license issued to the driver was suspended.

Malcolm Seay was arrested and charged with possession of marijuana, driving with a suspended license, and evading arrest. He was later freed on pre-trial release.
