32-year-old James Lowery was charged with two counts of aggravated assault after his lover told authorities that he blacked-out in a rage before strangling her, then held a gun to her head while laughing and told her he was “just kidding.”
On July 20th, Metro Nashville Police officers were dispatched to 135 Donelson Pike in reference to a reported rape. When officers arrived, they made contact with Melanie Ferrell who stated James Lowery assaulted her. Ferrell told officers that the previous day she told Lowery to move some of his belongings in her apartment. She claimed that he went into a rage and blacked out before telling officers Lowery had put her into a headlock, held her on the bed, and said, “don’t you ever fucking talk to me like that again” while strangling her.
According to the affidavit, she did not become unconscious but did have trouble breathing. After the strangling, Ferrell said she told Lowery, ” if you’re going to kill me, just kill me”. Lowery then proceeded to wave around his semi-automatic pistol and placed it to her head and laughed before telling her “just kidding”. She immediately left the apartment and went to Walmart, where she remained until 7 a.m. Officers observed bruising and redness on Ferrell’s neck that supported her version of event and noticed her voice was hoarse when they spoke with her.
On October 28th, James Lowery was arrested and charged with aggravated assault by strangulation and aggravated assault with a deadly weapon. He was released on a $20,000 bond.
