19-year-old Michael Givan was seen swerving in his lane at Interstate 24 East on April 16th. Officers closely observed Givan continue to do this and rapidly change his speed. A traffic stop was conducted when Givan’s erratic behavior continued. When officers contacted Givan, they noticed two passengers in the back seat and another in the front seat. Givan was questioned about how he was driving, and he stated that he was “trying to keep up with his parents,” who were in front of him. While speaking to Givan, an officer reportedly noticed the smell of marijuana coming from his vehicle. Givan appeared nervous to the officer, so he asked for his license, which he said he left at home. Givan was told to exit the car and was asked if he had any marijuana on him or inside his vehicle. Givan shortly confessed that there was a bag of marijuana on the driver’s side door. Officers returned to the car to seize the bag of marijuana but instead found that Givan’s step-brother, Anthony Allen, climbed across the center console into the driver’s seat. Allen also appeared to be under the influence of marijuana, so he was told to exit the car. Givan was asked if Allen had any marijuana in his possession, and Givan told them that he believed he did.

Officers asked Allen if there was any marijuana on his person, and he admitted that there was. The two other passengers were asked to leave the vehicle so officers could search it. Officers located a plastic baggie containing marijuana and a blue backpack containing a plastic sandwich bag with several marijuana joints inside. During the search, law enforcement found that Givan’s license was suspended in Kentucky for failing to complete traffic school. An officer requested Givan to perform sobriety tests to see if he could still operate his car. Givan consented to the sobriety tests but performed poorly. The total amount of marijuana seized was 19.1 grams.

Michael Givan was taken into custody and charged with simple possession, driving under the influence, and driving on a suspended license on April 17th.
