Jessie James Upchurch, 61, (and frequently seen with Fast Fredie) appeared in General Sessions court today to answer to a burglary charge from a July 17th incident on the 800 block of Boscobel, where he was caught stealing an air compressor, both in video and still photos while the crime was in progress. He was arrested later that evening, and has remained in jail on a $10,000 bond since. Upchurch appeared in front of Judge Mondelli on Wednesday morning, where he accepted a plea deal. The original charge was a class D Felony of burglary, the plea he accepted was a Misdemeanor charge of Theft under $500. The accompanying public intoxication charge was dismissed. Upchurch was sentenced to 60 days in jail, for which he already has 50.5 days of jail credit to be applied. POLICE WERE DISPATCHED TO 8xx BOSCOBEL STREET IN REGARDS TO SOMEONE BREAKING IN TO THE RESIDENCE’S GARAGE AND STEALING THE VICTIM’S AIR COMPRESSOR. THE WITNESS HAD THE DEFENDANT ON VIDEO COMING FROM THE BACK GATE OF THE RESIDENCE WITH ANOTHER MALE WHITE PULLING A BLUE AIR COMPRESSOR. THE WITNESS VIDEO TAPED THE DEFENDANT AND THE OTHER MALE WHITE LEAVING 8xx BOSCOBEL ST AND WALK ACROSS SHELBY AVE INTO AN ALLEY. DUE TO OFFICERS HAVING SEVERAL ENCOUNTERS WITH THE DEFENDANT, OFFICERS WERE ABLE TO IDENTIFY THE DEFENDANT FROM THE VIDEO. OFFICERS STOPPED THE DEFENDANT IN THE ALLEY AT SOUTH 9TH ST AND SYLVAN ST WITH THE SAME CLOTHING DISCRIPTION AS IN THE VIDEO. THE DEFENDANT WAS VERY INTOXICATED AND COULD NOT TELL OFFICERS WHERE THE OTHER INDIVIDUAL WAS. OFFICERS PLACED THE DEFENDANT INTO CUSTODY AND TRANSPORTED TO BOOKING.
