27-year-old Zackery Abriola was charged with implied consent, boating under the influence, and negligent operation of a boat after allowing a passenger to ride on the top of a double-decker pontoon boat and admitting to drinking while boating on the lake.
On June 13th, Tennessee Wildlife Resources Agent Landrum noticed a two-tiered pontoon boat with a passenger riding on the top tier. This being reckless operation, Landrum conducted a stop on the boat. Landrum observed that the operator’s face was flushed and that he emitted a scent of alcohol from his person. The officer asked the operator, later identified as Zackery Abriola, how much he had to drink throughout the day. According to the affidavit, before Abriola was able to answer, an additional passenger on the vessel exclaimed “Nothing!”

The operator of the boat proceeded to confess to having as many as three drinks over the course of four hours on the water. Landrum then advised Abriola to put on a life jacket and enter his watercraft. Abriola allegedly had trouble donning the jacket, putting the vest on backward to begin, then readjusting before boarding Landrum’s vessel.
Field sobriety tests were administered on Abriola, to which he showed signs of inebriation throughout, per report. Landrum proceeded to place Abriola into custody for boating under the influence. After being read the Tennessee implied consent form, Abriola denied the opportunity to provide a sample of his blood.
Zackery Abriola was arrested and charged with implied consent, boating under the influence and negligent operation of a boat. He was later freed on pre-trial release.
