36-year-old Erin Justesen was booked into the Metro Nashville Jail Wednesday after neighbors found her crawling around their lawns, screaming, and causing a neighborhood disturbance while admittedly intoxicated. We covered her arrest last year when she was also intoxicated and punched her mother’s new boyfriend in the kitchen while he was making coffee.
ARREST WARRANT / AFFIDAVIT:
OFFICERS WERE DISPATCHED TO A REPORTED INTOXICATED PERSON CALL. OFFICERS WERE NOTIFIED BY DISPATCH THAT POLICE WERE CALLED BECAUSE THE DEFENDANT WAS BANGING ON HER DOOR AT HER RESIDENCE AND STUMBLING DOWN THE STREET. UPON ARRIVAL, OFFICERS PERSONALLY OBSERVED THE DEFENDANT WALKING THROUGH YARDS IN THE AREA.
OFFICERS MADE CONTACT WITH THE DEFENDANT WHO WAS SHOWING OBVIOUS SIGNS OF INTOXICATION SUCH AS SLURRED SPEECH, ERRATIC BEHAVIOR, AND THE SMELL OF ALCOHOL COMING FROM HER BREATH. THE DEFENDANT WAS ALSO OBSERVED DRINKING AN OPEN BEER CAN ON THE GROUND. ONE CITIZEN CAME OUT AND STATED SHE WAS SCREAMING SO LOUDLY, HE HAD TO GO OUTSIDE AND CHECK TO SEE IF SHE WAS OKAY.
WHILE OFFICERS WERE SPEAKING TO THE DEFENDANT, SHE BEGAN SCREAMING VERY LOUDLY, TO THE POINT THAT NEIGHBORS HAD ALREADY CALLED POLICE ABOUT HER, AND BEGAN CREATING SO MUCH NOISE, THAT IT WAS PREVENTING OTHERS FROM CARRYING ON LAWFUL ACTIVITIES. THE DEFENDANT WAS ALSO CRAWLING IN OTHER CITIZEN’S YARDS AND WALKED INTO THE STREET, DESPITE ORDERS FROM OFFICERS TO STAY OUT OF THE STREET FOR HER OWN SAFETY.
THE DEFENDANT ALSO STATED SEVERAL TIMES WITHOUT QUESTIONING THAT SHE WAS DRUNK. OFFICERS DETERMINED DUE TO THE DEFENDANT’S LEVEL OF INTOXICATION CAUSING HER TO ENDANGER HER OWN SAFETY, AS WELL AS HER ACTING EXTREMELY DISORDERLY IN PUBLIC, THAT THE DEFENDANT NEEDED TO BE TAKEN INTO CUSTODY.
