In the early hours of Saturday morning, police found 27-year-old flight attendant Austin Shane Boyette driving in the wrong direction on a one-way street with two completely flat tires. Officers conducted a traffic stop, and Boyette acknowledged he was aware of the two tires, stating he had attempted to fill them up with air, unsuccessfully. After failing all three field sobriety tests, Boyette blew a 0.14% BAC on the breathalyzer and admits to drinking “five beers and some wine beverages” prior to driving.
|ARREST WARRANT / AFFIDAVIT:
|POLICE CONDUCTED A TRAFFIC STOP AND PULLED THE SUBJECT OVER FOR DRIVING THE WRONG WAY ON A ONE-WAY ROAD. POLICE APPROACHED THE SUBJECT’S VEHICLE AND SPOKE TO HIM. POLICE CAN SMELL A SLIGHT ODOR OF ALCOHOL COMING FROM THE SUBJECT. POLICE ALSO NOTICED THAT THE SUBJECT’S VEHICLE HAD TWO FLAT TIRES, AND HE HAD BEEN DRIVING ON THE ROAD THAT WAY.
POLICE ALSO NOTICED THAT THE SUBJECT HAD SLURRED SPEECH AND HIS EYES WERE BLOODSHOT RED. POLICE HAD THE SUBJECT STEP OUT OF THE VEHICLE. POLICE ASKED THE SUBJECT ABOUT THE VEHICLE’S FLAT TIRES. THE SUBJECT STATED THAT HE TRIED TO FILL THE TIRES UP WITH AIR AND ADMITTED TO DRIVING THE VEHICLE THAT WAY. BOTH TIRES WERE COMPLETELY FLAT.
POLICE THEN ASKED THE SUBJECT IF HE WOULD AGREE TO DO A FIELD SOBRIETY TEST AND THE SUBJECT AGREED. THE SUBJECT FAILED ALL THREE FIELD SOBRIETY TESTS. POLICE PLACED THE SUBJECT UNDER ARREST AND READ HIM HIS MIRANDA RIGHTS.
THE SUBJECT ADMITTED TO DRINKING 5 BEERS EARLIER IN THE NIGHT. HE ALSO ADMITTED TO DRINKING WINE BEVERAGES. POLICE THEN TRANSPORTED THE SUBJECT TO BOOKING AND ADMINISTERED A BREATHALYZER TEST. THE B.A.C LEVEL WAS 0.14
