ARRESTED: Singer/Songwriter Clay Evans. Public Intox / Disorderly Conduct

Nashville Singer / Songwriter Clay Wisdom Evans, was arrested on his 3rd public intoxication charge this morning, just after last call. Evans was booked into the Davidson County Sheriff’s Office at 3:33 AM.

UPDATE: Today’s public intoxication charge has been dismissed, however he remains out on Pre-Trial Diversion from a June 25th arrest for another public intoxication charge, as well as disorderly conduct. Evans was released from custody at just before noon, with an October 2nd court date for his previous charges, still open.

Here was the affidavit from last night:

ON 08/07/2017 I WAS DISPATCHED TO THE FAMOUS SALOON LOCATED AT 110 2ND AVE N FOR A SUBJECT POUNDING ON THE WINDOWS AND REFUSING TO LEAVE. UPON ARRIVAL, THE DEFENDANT WAS LOOKING THROUGH THE WINDOWS STARING AT THE EMPLOYEES IN THE BAR. THE DEFENDANT HAD A STRONG ODOR OF AN ALCOHOLIC BEVERAGE ON HIS PERSON AND BREATHE. THE DEFENDANT HAD SLURRED SPEECH AND WAS EXTREMELY UNSTEADY ON HIS FEET. THE DEFENDANT REFUSED TO IDENTIFY HIMSELF AND COULD NOT PROVIDE PROOF OF IDENTIFICATION ON WHO HE WAS. THE DEFENDANT WAS VERY ARGUMENTATIVE THROUGHOUT THE TRANSPORT TO BOOKING. THE DEFENDANT WAS A DANGER TO HIMSELF AND UNREASONABLY ANNOYED PEOPLE IN THE VICINITY.

From the June 25th arrest report:

OFFICERS SELF-INITIATED A DISORDERLY CALL AT 3RD AV S/DEMONBREUN (NEAR THE DINER). MR. EVANS WAS IN A VERBAL ALTERCATION AT THIS LOCATION WITH ANOTHER INDIVIDUAL AND WALKING AGGRESSIVELY IN THEIR DIRECTION. OFFICERS ASKED MR. EVANS 3 TIMES TO STOP YELLING AND WALKING AGGRESSIVELY (FIST BALLED AND WALKING QUICKLY) TOWARDS THE INDIVIDUAL. EACH TIME HE REFUSED AND CONTINUED HIS DISORDERLY BEHAVIOR. ON OFFICERS THIRD REQUEST FOR MR. EVANS TO STOP, HE TURNED AROUND AND STARTED WALKING AWAY FROM THE INDIVINDIVIDUALS. AT THIS TIME HE BEGAN YELLING MORE AND THREW HIS HAT ON THE GROUND. IT WAS AT THIS TIME OFFICERS DETERMINED MR. EVANS WAS TOO INTOXICATED FOR HIS/OTHERS SAFETY. HE WAS UNREASONABLYANNOYING PEOPLE IN THE VICINITY AND THERE WAS A REASONABLE LIKELIHOOD THE OFFENSE WOULD CONTINUE. MR. EVANS WAS CLEARLY UNDER THE INFLUENCE OF SOMETHING. HE HAD FRUITY BREATH AND ABNORMALLY SMALL PUPIL SIZE. IT IS UNKNOWN IF HE WAS UNDER THE INFLUENCE OF ALCOHOL OR SOMETYPE OF NARCOTIC. HE WAS TAKEN INTO CUSTODY FOR HIS INTOXICATION LEVEL AND DISORDERLY CONDUCT.

An April 6th 2015 arrest report, for which he was found guilty of a drug related charge, references a concurrent arrest for public intox, but that specific record seems to have been expunged from the records, other than this reference the the 04/06 affidavit:

THE DEFENDANT WAS ARRESTED FOR PUBLIC INTOXICATION. A SEARCH INCIDENT TO ARREST REVEALED A MARIJUANA PIPE WITH MARIJUANA RESIDUE IN THE BOWL. IT WAS FOUND IN HIS JACKET POCKET.

Evans had another encounter with MNPD in 2010 at the Renaissance Hotel Downtown, for which charges were dismissed, with costs to the defendant :

On 2-26-10 at approximately 0230 hrs, Security Officer Matz was called to the 18th floor of the Renaissance Nashville Hotel on a noise complaint. He told all of the people in the hallway and specifically in suite 1813 that, if they were not registered guests on that floor, they had to clear out. Everyone complied except for the defendant, who was loud and belligerent. Approximately 10 minutes later Ofc Matz encountered the defendant again, still on the 18th floor. Ofc Matz again told the defendant to leave. The defendant responded “Fuck you!” and “Come on and make me leave!” Ofc Matz called police. When an elevator arrived on the floor, the defendant ran inside. Ofc Matz followed to ensure that he did actually leave the hotel. As Ofc Matz attempted to get on the elevator, the defendant stated, “You are not getting on this elevator with me.” Ofc Matz said he was and the defendant forcefully pushed Ofc Matz in the chest with his open palm. As Ofc Matz tried to get on again, the defendant pushed him again.

Clay Evans booking photo from a FL DUI Arrest

This recent string of contacts with law enforcement are not the first for Evans – he was charged with DUI in Florida previously, which was reduced to a lesser charge for which he received probation & community service. According to court records, he still owes fees and fines both here in Nashville, and in Florida, for several cases.

Evans is scheduled to appear in court on October 2 for his two open cases in Nashville.
